Introduction

This page sets out our Service Terms and Conditions. We have added explanations in plain English, and then the full terms.

Expectations

This service is intended to help you identify, record and share your health concerns, and help to support you in communicating them.

Globefox Health does not provide advice or guidance about your health, but we do provide advice and guidance on identifying, recording and communicating your health issues and concerns.

We make no warranty or promise whatsoever as to the medical or factual accuracy of the reports that our service generates. Our reports and the information they contain are based on the responses and information that you provide to us.

Your Health Story Reports are for your own personal use. These are personal to you, and we recommend that you only share them with your doctors and those who care for you. If you are filling out the form for someone else, you are responsible for making sure that this person’s information is treated as confidential and kept private.

Health Story Reports is currently disabled, this is to help keep your data secure while we set up our systems. If you copy or store your Health Story
Reports or any part of them, then you are responsible for keeping them safe and secure, we no longer have responsibilty for this.

We are not liable for any unforeseen consequences arising from your use of the service, and of the information that you provide to us and that we use to create your health story reports. We recommend that you discuss the issue and insights you discover with a trusted person.  

The guidance and information that we provide to help you do this is subject to change, as is the service itself. This may be due to improvements we make or to changes in government policy and law. We will give you notice of these changes if we believe that they will affect your use of the service.

Any content that we may provide or share with you is for information purposes only. Should you come across something that you believe relates to you or to your condition, please seek professional medical advice.

Our one-to-one support sessions are NOT counselling, or a medical appointment, and are no substitute for medical or specialist care. This support offered on a limited Pilot basis, and is subject to availabilty. Specific booking terms will be provided before bookings are made.

Data use

We take the privacy of your data and personal information very seriously.

Your reports are private. Please do not upload your reports to public sites, or share them with anyone except your doctor or health professional, or someone that looks after you.

Access to the service

Access to the full serivce requries an active subscription. You can access your Reports for a year after you hav last paid for access.

Should the service become temporarily unavailable for any reason we reserve the right to suspend your access.

We will endeavour to communicate with you and let you know when we expect the service to be restored within a reasonable period of time.

Should the service continue to be unavailable and we have no expectation of being able to restore it within the trial period, we reserve the right to close your account and refund your fee in full.

As this is a prototype service, we provide no warranty for the availability of the service or your data.

While we do not intend to delete your data from the system at the end of the early access period, unless you request us to do so, there may be circumstances under which your data has to be removed or changed. If we do this we will inform you, and give you the opportunity to download your data..  

Payments

We accept payments via Stripe. You can use most major cards or Google pay.

Once your payment has been received, we will email you with joining instructions.

Refunds

Refunds may be offered under specific circumstances, and in accordance with the terms and condittions of specific offers. The sum refunded will not exceed the sum paid.

Use of our Website

  1. Scope
    1. These terms and conditions apply to users who have an active account on the GlobeFox Health web site to use our Health Tracker service.
       
  2. Changes to Our Site
     
    1. We may alter and update the website  (or any part of it) at any time, to update our terms, or comply with a change in regulations. If we make any significant alterations to the website (or any part of it), and that may affect your use of the site, we will try to give you reasonable notice of the alterations.
       
  3. Changes to these Terms and Conditions
     
    1. We may alter these Terms and Conditions at any time. If We do so, details of the changes will be highlighted at the top of this page. Your use of the website constitutes your acceptance of these Terms and Conditions. Consequently, any changes made to these Terms and Conditions will apply to your use of the website the first time you use it after the changes have been implemented.
       
    2. If any part of the current version of these Terms and Conditions conflicts with any previous version(s), the current version shall prevail unless explicitly state otherwise.
  4.  International Users
     
    1. The website is intended for users residing in the United Kingdom only. We do not warrant or represent that the website or its content are available in other locations or are suitable for use in other locations.
       
  5. How You May Use Our Site and Content (Intellectual Property Rights)
     
    1. All Content included on the website and the copyright and other intellectual property rights in that content belongs to GlobeFox Health or has been licensed by GlobeFox Health, unless specifically labelled otherwise. All Content is protected by applicable English law and international intellectual property laws and treaties.
       
    2. You may access, view, and use the website in a web browser (including any web browsing capability built into other types of software or app) and you may download the website (or any part of it) for caching including automated caching by your browser or other technologies..
       
    3. Images, video, audio, or any other Content downloaded from Our Site must not be used separately from accompanying text.
       
    4. Our status as the owner and author of the Content on Our Site (or that of identified licensors, as applicable) must always be acknowledged.
       
    5. You may not use any Content from Our Site for commercial purposes without first obtaining a licence from Us (or our licensors, as applicable). This does not prevent the normal access, viewing, and use of Our Site for general information purposes by business users or consumers.
       
    6. Printing of Health Story Reports is currently disabled, while we set up our security systems. In the meansitrme we suggest that you share your Reports on screen on a mobile phone,tablet, or laptop. Once print access is granted, you may download and print your Health Story Reports or pages from them for your own personal use. These may only be shared with your doctors and those who care for you, and must not be made public or uploaded to publicly available websites and forums.
  6. Links to Our Site
     
    1. Links to Our Site must be fair and lawful. You must not take unfair advantage of Our reputation or attempt to damage Our reputation.
       
    2. You must not link to Our Site in a manner that suggests any association with Us (where there is none) or any endorsement or approval from Us (where there is none).
       
    3. Your link should not use our  logos or trade marks displayed on the website without our express written permission.
       
    4.  You must not frame or otherwise embed Our Site on another website without Our express written permission.
       
    5. You may not link to Our Site from another website the main content of which is unlawful; obscene; offensive; inappropriate; dishonest; defamatory; threatening; racist, sexist, or otherwise discriminatory; that promotes violence, racial hatred, or terrorism; that infringes intellectual property rights. We reserve the right to ask for links to be removed for any reason.
       
  7. Links to Other Sites
     
    1. Links to other websites may be included on Our Site. Unless expressly stated, these sites are not under Our control. We accept no responsibility or liability for the content of third-party websites.
       
    2. The inclusion of a link to another website on Our Site is for information purposes only and does not imply any endorsement of that website or of its owners, operators, or any other parties involved with it. Unless explicitly state otherwise.

    1. Nothing on Our Site constitutes professional advice on which you should rely. It is provided for general information purposes only. Professional or specialist advice should always be obtained before taking any action relating to your health and wellbeing.
       
    2. We make reasonable efforts to ensure that the Content on Our Site is complete, accurate, and up to date, but We make no warranties, representations, or guarantees (express or implied) that this will always be the case.
       
    3. If you are a business user, We exclude all implied representations, warranties, conditions, and other terms that may apply to Our Site and Content.
       
  9. Terms of Sale
     
    1. These Terms of Sale, together with any and all other documents referred to herein, set out the terms under which Our Pilot Services are sold and provided by Us through this website, https://www.globefoxhealth.com  (“Our Site”). 
       
    2. Please read these Terms of Sale carefully and ensure that you understand them before ordering any Our Pilot Services from Our Site.  You will be required to read and accept these Terms of Sale when ordering Our Pilot Services.  If you do not agree to comply with and be bound by these Terms of Sale, you will not be able to order Our Pilot Services through Our Site.  These Terms of Sale, as well as any and all Contracts are in the English language only.

 

 

Terms of Sale

Definitions and Interpretation

In these Terms of Sale, unless the context otherwise requires, the following expressions have the following meanings:

“Contract”

means a contract for the purchase and sale of Our Pilot Services, as explained in Clause 8;

“Order”

means your order for the Our Pilot Services;
 

“Order Confirmation”

means our acceptance and confirmation of your Order;

“Our Pilot Services”

means the Our Pilot Services which are to be provided by Us to you as specified in your Order (and confirmed in Our Order Confirmation); and

“We/Us/Our”

means Globefox Ltd, a limited company registered in England under registration number 03715477, whose registered address is 10 Boundstone Rd, Wrecclesham, Farnham GU10 4TQ and whose main trading address is 10 Boundstone Rd, Wrecclesham, Farnham GU10 4TQ.

  2. We are regulated by Ofcom.
     
  3. Our Pilot Services are governed by our general Terms and Policies that are publicly available on Our Site.
     
  1. Access to and Use of Our Site
     
    1. Access to Our Site is free of charge, and subject to the ‘Website Terms and Conditions’ above.  Some pages, resources and Our Pilot Services require a subscription.
       
    2. We have taken reasonable steps to ensure that our site is accessible to as many people as possible. It is your responsibility to make any and all further arrangements necessary in order to access Our Site.
       
    3. Access to Our Site is provided “as is” and on an “as available” basis.  We may alter, suspend or discontinue Our Site (or any part of it) at any time and without notice.  We will not be liable to you in any way if Our Site (or any part of it) is unavailable at any time and for any period.
       
    4. Use of Our Site is subject to our Website Terms of Use.  Please ensure that you have read them carefully and that you understand them.
       
  2. Age Restrictions
     
    1. Consumers may only purchase and use Our Pilot Services through Our Site if they are at least 18 years of age.
       
  3. Business Customers
     
    1. These Terms of Sale do not apply to customers purchasing Our Pilot Services in the course of business. If you are a business customer, please contact us to discuss terms.
       
  4. Our Pilot Services Location
     
    1. Our paid Our Pilot Services are only available to users resident in the  United Kingdom.
       
  5. Our Pilot Services, Pricing and Availability
     
    1. We make all reasonable efforts to ensure that all general descriptions of the Our Pilot Services are correct.
       
    2. Where appropriate, you may be required to select the required Level of Our Pilot Services.
       
    3. We neither represent nor warrant that all Our Pilot Services will be available at all times.
       
    4. We make all reasonable efforts to ensure that prices shown on Our Site are correct.  We reserve the right to change prices from time to time and as necessary.
       
    5. All prices on Our Site include VAT.
       
  6. Orders
     
    1. No part of Our Site constitutes a contractual offer capable of acceptance, Your Order constitutes a contractual offer that We may, at Our sole discretion, accept.  Our acknowledgement of receipt of your Order does not mean that We have accepted it.  Our acceptance is indicated by Us sending you an Order Confirmation by email.
       
    2. If We, for any reason, do not accept or cannot fulfil your Order, no payment shall be taken under normal circumstances.  If We have taken payment any such sums will be refunded to you as soon as possible and in any event within 28 days.
       
    3. If you change your mind, you may cancel your Order or the Contract before or after We begin providing the Our Pilot Services subject to these Terms of Sale. For details of your cancellation rights, please refer to Clauses 11 and 12.
       
    4. We reserve the right to cancel your Order at any time before We begin providing the Our Pilot Services.
       
    5. If We cancel your Order under 8.8 and We have taken payment any such sums will be refunded within 28 days. If We cancel your Order, you will be informed by email.
       
    6. Any refunds due under this Clause 8 will be made using the same payment method that you used when ordering the Our Pilot Services.
       
  7. Payment
     
    1. We accept the following methods of payment via the payment site
      1. Stripe.com.
      2. Google Pay.
      3. Credit and Debit card.
         
    2. We do not charge any additional fees for any of the payment methods listed in 8.1.
       
  8. Provision of the Our Pilot Services
     
    1. We will provide the Our Pilot Services with reasonable skill and care, consistent with best practices and standards in the digital healthcare market. We will begin providing the Our Pilot Services on the date agreed when you make your Order (which We shall confirm in the Order Confirmation). 
       
    2. We will continue providing the Our Pilot Services for a period of one calendar month after you place your order, after which time you will need to order again.
       
    3. We will make every reasonable effort to provide the Our Pilot Services in a timely manner..  We cannot, however, be held responsible for any delays if an event outside of Our control occurs.
       
    4. If We require any information or action from you in order to provide the Our Pilot Services, We will inform you of this as soon as is reasonably possible.
        
    5. If the information you provide or the action you take under 9.4  is delayed, incomplete or otherwise incorrect, We will not be responsible for any delay caused as a result.  If additional work is required from Us to correct or compensate for a mistake made as a result of delayed, incomplete or otherwise incorrect information or action that you have provided or taken, We reserve the right to charge you a reasonable additional sum for that work.
       
    6. If we need to suspend or otherwise interrupt the Our Pilot Services to resolve the issue.  Unless the issue is an emergency that requires immediate action We will inform you in advance by email.
       
    7. If the Our Pilot Services are suspended or interrupted under 9.6 and 9.7 you will not be required to pay for them during the period of suspension.
       
  9. Cancellation
     
    1. A payment for Our Pilot Services is a one off fee that covers access for a period of one month, due before the service commences. While it is within your rights to cancel the service, we cannot offer you a refund.
       
    2. If you wish to cancel you must inform Us of your decision to do so.  You may do so in any way you wish, however for your convenience We offer a cancellation form on Our Site https://www.globefoxhealth.com/form/cancellations-and-refunds.
       
  10. Our Rights to Cancel
     
    1. We may cancel Our Pilot Services after We have begun providing them. In such cases, you will only be required to pay for Our Pilot Services that We have already provided up until the point at which We inform you that We are cancelling the contract.
       
    2. Once We have begun providing the Our Pilot Services, We may cancel the Contract at any time and will give you 14 calendar days’ written notice of such cancellation.
       
    3. We may cancel immediately by giving you written notice in the following circumstances:
      1. You breach the contract in a material way and fail to remedy the breach within 14 calendar days of Us asking you to do so in writing.
         
  11. Problems with the Our Pilot Services and Your Legal Rights
     
    1. We always use reasonable endeavours to ensure that the Our Pilot Services are trouble-free.  If, however, there is a problem with the Our Pilot Services please contact Us as soon as is reasonable possible via [email protected].
       
    2. We will use reasonable endeavours to remedy problems with the Our Pilot Services as quickly as is reasonably possible and practical.  In emergency situations, such as those where vulnerable people may be affected, We will use reasonable endeavours to remedy problems within 24 hours.
       
    3. We will not charge you for remedying problems where the problems have been caused by Us, any of Our agents or sub-contractors, or where nobody is at fault.  If We determine that a problem has been caused by you, including your provision of incorrect or incomplete information or taking of incorrect action, sub-Clause 10.5 will apply and We may charge you for the remedial work.
       
  12. Our Liability
     
    1. We are not responsible for unforeseeable loss or damage that you may suffer as a result of Our breach of these Terms of Sale or as a result of Our negligence.  Loss or damage is foreseeable if it is an obvious consequence of Our breach or negligence or if it is contemplated by you and Us when the Contract is created.  We will not be responsible for any loss or damage that is not foreseeable.
       
    2.  Our Pilot Service enables you to record, view and share your health concerns and is not a diagnostic tool or medical device.  Any content we provide is for information use only, and does not constitute medical advice or guidance.
       
    3. We provide Our Pilot Services for domestic and private use or purposes.  We make no warranty or representation that the Our Pilot Services are fit for commercial, business or industrial purposes of any kind at this time.  We will not be liable to you for any loss of profit, loss of business, interruption to business or for any loss of business opportunity.
       
    4. Nothing in these Terms of Sale seeks to exclude or limit Our liability for death or personal injury caused by Our negligence (including that of Our employees, agents or sub-contractors); or for fraud or fraudulent misrepresentation.
       
    5. Nothing in these Terms of Sale seeks to exclude or limit Our liability for failing to perform the Our Pilot Services with reasonable care and skill or in accordance with information provided by Us about the Our Pilot Services or about Us.
       
    6. Nothing in these Terms of Sale seeks to exclude or limit your legal rights as a consumer. For more details of your legal rights, please refer to Your local Citizens Advice Bureau or Trading Standards Office.
       
  13. Events Outside of Our Control (Force Majeure)
     
    1. We will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond Our reasonable control.  Such causes include, but are not limited to: power failure, internet service provider failure, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other event that is beyond Our reasonable control
       
    2. If any event described in 14.1 occurs that is likely to adversely affect Our performance of any of Our obligations under these Terms of Sale:
      1. We will inform you as soon as is reasonably possible;
      2. Our obligations under these Terms of Sale (and therefore the Contract) will be suspended and any time limits that We are bound by will be extended accordingly;
      3. We will inform you when the event outside of Our control is over and provide details of any new dates, times or availability of Our Pilot Services as necessary;
      4. If the event outside of Our control continues for more than 14 days We may cancel the Contract and inform you of the cancellation.  Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible and in any event no later than 14 calendar days after the date on which We inform you of the cancellation;
      5. If an event outside of Our control occurs and continues for more than 14 days  and you wish to cancel the Contract as a result, you may do so in any way you wish, however for your convenience

    3. In each case, please provide Us with your name, address, email address, telephone number, and Order Number.  Any refunds due to you as a result of such cancellation will be paid to you as soon as is reasonably possible and in any event no later than 14 calendar days after the date on which you inform Us that you wish to cancel.

    1. We always welcome feedback from Our customers and, whilst We always use all reasonable endeavours to ensure that your experience as a customer of Ours is a positive one, We nevertheless want to hear from you if you have any cause for complaint.

  16. How We Use Your Personal Information (Data Protection)
    1. We will only use your personal information as set out in Our Privacy Policy, available from https://www.globefoxhealth.com/terms-and-policies
       
  17. Other Important Terms
     
    1. We may transfer (assign) Our obligations and rights under these Terms of Sale (and under the Contract, as applicable) to a third party (this may happen, for example, if We sell Our business).  If this occurs, you will be informed by Us in writing.  Your rights under these Terms of Sale will not be affected and Our obligations under these Terms of Sale will be transferred to the third party who will remain bound by them.
       
    2. You may not transfer (assign) your obligations and rights under these Terms of Sale (and under the Contract, as applicable) without Our permission.
       
    3. The Contract is between you and Us.  It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms of Sale.
       
    4. If any of the provisions of these Terms of Sale are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms of Sale.  The remainder of these Terms of Sale shall be valid and enforceable.
       
    5. No failure or delay by Us in exercising any of Our rights under these Terms of Sale means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms of Sale means that We will waive any subsequent breach of the same or any other provision.
       
    6. We may revise these Terms of Sale from time to time in response to changes in relevant laws and other regulatory requirements.
       
  18. Law and Jurisdiction
     
    1. These Terms and Conditions, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of England & Wales.
       
    2. If you are a consumer, you will benefit from any mandatory provisions of the law in your country of residence. Nothing in 19.1 takes away or reduces your rights as a consumer to rely on those provisions.
       
    3. If you are a consumer, any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
       
    4. If you are a business, any disputes concerning these Terms and Conditions, the relationship between you and Us, or any matters arising therefrom or associated therewith (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England & Wales.
